US v. Wineman, No. 10-1121
Methamphetamine Sentence Affirmed
In US v. Wineman, No. 10-1121, the court affirmed defendant's sentence for conspiracy to distribute methamphetamine, holding that the district court did not commit significant procedural error in calculating the advisory guidelines range.
As the court wrote: "Russell Wineman pled guilty to conspiracy to distribute methamphetamine in violation of 21 U.S.C. §§ 841(a)(1) and 846, and the district court1 sentenced him to 235 months' imprisonment. Wineman appeals his sentence, arguing that the district court should have granted his request for a two-level reduction for acceptance of responsibility under United States Sentencing Guidelines § 3E1.1(a). Because the district court did not clearly err in denying Wineman's request, we affirm."
