US v. Paz, No. 10-1683
In US v. Paz, No. 10-1683, the court affirmed defendant's sentence for illegal reentry into the United States in violation of 8 U.S.C. section 1326(b), holding that the district court properly applied the sentencing enhancement for illegal reentry into the U.S. after a prior crime of violence, namely sexual assault under Arkansas law.
As the court wrote: "Melvin Geovani Paz pled guilty to illegal reentry into the United States in
violation of 8 U.S.C. § 1326(b). He appeals the district court's1 16-level sentencing enhancement for his prior deportation after a conviction for a "crime of violence." Having jurisdiction under 28 U.S.C. § 1291, this court affirms."
