Ray J's Arrest Spurred by Sexual Battery Allegation
Actor, musician and Kim Kardashian sex tape star Ray J made sex-related headlines again last week when a woman claimed that he touched her butt. But that's not what got him arrested.
The incident, at the Beverly Wilshire Hotel in Beverly Hills, was determined by police to be a case of "incidental" contact and not sexual battery, reports TMZ.
Ray J still managed to get himself arrested, however.
For the Love of... Ray J?
After police determined that a crime had not been committed, Ray J was asked to leave the hotel. But he refused to drive off once he reached the valet area. Hotel security made a citizen's arrest, detaining Ray J until police arrived, again.
Ray J reportedly spit in an officer's face before kicking out the rear window of a police car. He was charged with trespassing, vandalism, resisting arrest, and battery on a police officer.
What Is Sexual Battery?
Under California law, a sexual battery occurs when a person "touches an intimate part of another person, if the touching is against the will of the person touched, and is for the specific purpose of sexual arousal, sexual gratification, or sexual abuse." This rule applies to any form of touching, even through clothing, of a sexual organ, woman's breast or as in this case, butt.
Although police found that although Ray J probably did touch the woman's butt, he lacked the intent required to be guilty of the crime, which for sexual battery in California is that the touching be done for the "specific purpose" of sexual gratification of some kind. The punishment in California for sexual battery is a fine of up to $2,000 and/or six months in jail.
Unfortunately for Ray J, his subsequent meltdown got him charged with an even more serious offense: battery on a police officer which, if he's convicted, could land him in jail for up to a year.
