Dismissal of Former Car Salesman's Age Discrimination in Employment Suit Affirmed

Melendez v. Autogermana, Inc., 09-1804, concerned a challenge to the district court's dismissal of plaintiff's discriminatory discharge claim and denial of plaintiff's motions for reconsideration, in the former car salesman's age discrimination in employment suit. 

 

 In affirming, the court held that there is insufficient evidence to draw the inference that impermissible age discrimination was the determinative factor in plaintiff's termination.  The court also held that there was no abuse of discretion in the district court's denial of plaintiff's motions for reconsideration, as plaintiff failed to point to any manifest error of law in the district court's judgment dismissing his ADEA claim.
