Lohan Off To Jail, Without An Attorney?

Annnndddd... scene. Believe it or not, actress Lindsay Lohan is finally headed to jail. After protracted legal wrangling over her probation violations stemming from 2007 DUI charges, La Lohan is finally headed to the big house. Or, make that the medium-sized Century Regional Detention Facility in Lynwood, California.

But Lindsay is not only facing her sentence of 90 days in jail and then an additional 90 days of rehab. She is also, per various sources, fresh out of legal representation. Reports say that veteran of the O.J. Simpson dream team, Robert Shapiro, quit Team Lindsay on the evening of July 19, right before she was due to surrender herself and begin her jail sentence on the following morning.

According to the omnipresent TMZ, at the brief hearing before she was to be taken to begin her sentence, Lohan was represented not by Shapiro, but by Shawn Chapman Holley, her previous attorney who had quit her position as Lohan's legal counsel.

Even though Chapman Holley had surrendered her position as Lohan's attorney, she may have been required to make this last appearance. When one attorney in a criminal case resigns their position and hands the case to another, a substitution of attorney document or pleading is filed with the court. According to yet another report by TMZ, in this case, Chapman Holley did not sign the substitution, and if the substitution of counsel was not approved by the judge or was otherwise incomplete, Holley still would be responsible as the attorney of record for ensuing her client had representation before the court.

It is likely that despite the massive amount of sturm and drang surrounding Lindsay's departure for the slammer, she will only serve a portion of her sentence. The Los Angeles County Sheriff's office has a long-standing policy of early release for non-violent offenders due to chronic over-crowding, reports People. It has been suggested that Lohan will serve as little as two weeks of her jail term. Hopefully, it will be enough to get her to make a few changes in her life for good - this time around.
