Kim Kardashian Hopes to Settle the Vibes Perfume Lawsuit
In news regarding yet another Kardashian infringement lawsuit, Vibes Media has requested an extension for the court date in its suit against Kim Kardashian West in the hopes of settling out of court. In July, Vibes Media sued KKW over the similarity of its logo with the look and shape of the KKW perfume bottle, which, coincidentally, is named Vibes.
Vibes Media Seeks Damages, Injunction, and All Inventory
Vibes Media registered a trademark for its logo back in 2012, and perhaps KKW and Co. missed it? The two look substantially similar, but differ in color, logotype, and dimension. Vibes Media is suing for damages, and an injunction to stop her from selling any more of the product. They also want possession of the unsold inventory so that they can destroy it. It's been reported that the July 17th launch of the Vibes perfume earned KKW $5 million in 5 minutes. This isn't her personal record -- she earned $14 million in 5 minutes when she launched KKW Cosmetics last year.
19 Suits and Counting!
This is just the latest trademark/copyright lawsuit that the Kardashian/Jenner clan has faced. They are usually the defendant, but at times, the plaintiff. In total, there have been at least 19 cease-and-desist letters and lawsuits. Almost all cases were settled or dismissed, and so Vibes belief that this will be settled out of court is valid.
Though Vibes Media is seeking injunctive and monetary relief, there are cases of criminal copyright and trademark infringement that, if convicted, carry fines of up to $250,000, and prison time: 5 years for first time offenders, 10 years for repeat offenders. Did I mention this was infraction #19. Now wouldn't that make a great new KUWTK spin-off!
