Garth Brooks Lawsuit: Country Singer Sues Hospital for a Breach of Contract
Country singer Garth Brooks donated money four years ago to his hometown hospital and now he wants it back.
He is suing Integris Canadian Valley Regional hospital in Yukon, Oklahoma for a breach of contract for $500,000, according to CNN.
The half a million dollars he donated was originally supposed to go towards a hospital building that was to be named after his late mother, Colleen, who died from cancer in 1999. Instead, the hospital launched a $27 million expansion and renovation project and today there is no building with his mother's name on it.
The hospital claims it was a misunderstanding and did not comment on the lawsuit.
Meanwhile, construction on a $27 million expansion continues at Integris Canadian Valley Regional Hospital, with new rooms expected to open in late 2009 or early 2010.
In addition, there are plans next summer to expand the area used for radiology, respiratory, pharmacy and dietary services.
The lawsuit for a breach of contract which was filed in the District Court in and for Rogers County, Oklahoma, in late September and is pending litigation.
In a nutshell, "breach of contract" involves a binding agreement that is not honored.
If someone fails to stick to their part of the bargain or does something against the contract then there is a breach.
Although not all breaches are "contract killers" some end up in lawsuits.
However when an individual or business breaches a contract, the other party to the agreement is entitled to relief (or a "remedy") under the law. The main remedies for a breach of contract are (1) damages, (2) specific performance, (3) or cancellation and restitution.
