Wrongful termination suit on the basis of disability

Faiola v. APCO Graphics, Inc., 10-1137, concerned a challenge to the district court's grant of summary judgment in favor of defendant employer, in plaintiff's suit against her former employer for wrongful termination on the basis of disability.

 

In affirming, the court held that plaintiff's theories of liability, that she was terminated because of her disabilities, and that the employer failed to provide a reasonable accommodation because it did not excuse her from flying to and attending a sales conference, fail because she did not make the required threshold showing of disability under the statutory scheme at issue.
