Botched Penis Injection Kills NJ Man

Botched butt injections are no joke, but botched penis injections are downright tragic. Just ask Justin Street, 22, of East Orange, N.J.

Alas, you can't. The poor man isn't with us anymore. 

A day after Kasia Rivera, 34, administered a penis injection, the silicone entered Street's bloodstream, causing a fatal blood clot. As a result, Rivera has been charged with involuntary manslaughter.

The injection was given in Rivera's home, reports the Star-Ledger. It most likely contained non-medical grade silicone, which is commonly used in these types of backroom procedures.

Regardless, liquid silicone injections have not been approved by the Food and Drug Administration. This is because the silicone has a tendency to migrate, causing blood clots and airway restriction. Injections have killed and injured dozens.

Persons illegally providing these injections would ordinarily be charged with the unauthorized practice of medicine. But because the botched penis injection killed Justin Street, Kasia Rivera is on the hook for manslaughter.

This will likely be an easy prosecution -- even though Street arguably consented to the procedure. Consent to bodily harm is not a defense under New Jersey law if the agreed upon conduct is illegal.

Consent is also not a defense to involuntary manslaughter because it does not negate an element of the crime. Defendants are liable under New Jersey manslaughter law if they recklessly disregarded the safety of the victim.

Justin Street's actions likely have little to no bearing on whether Kasia Rivera was criminally reckless. The possibility of side effects and the risk associated with a botched penis injection are just too high to ignore.
