Bail Money Posted for Actress Lindsay Lohan

Starlet Lindsay Lohan won't face jail time upon her return to the U.S. and her arrest warrant was rescinded.

Quick bail was posted for 23-year-old actress Lindsay Lohan and her attorney promised that Lohan would soon be in the courtroom, E! Online reports.

Lohan has been in Cannes and the French Riviera.

As previously discussed, Lohan was scheduled to appear in court and missed a mandatory hearing. Her bail was set at $100,000.

At the court hearing, attorney Shawn Chapman Holley, explained to the judge that Lohan's passport had been stolen.

The $10,000 bail -- the standard 10% -- was wired from Tennessee by Lou Taylor, Lindsay's business manager, TMZ reports.

Bail is cash, or a cash equivalent, that an arrested person gives to a court to ensure that he or she will appear in court when ordered to do so.

Bail can take any of the following forms:

  • cash or check for the full amount of the bail
  • property worth the full amount of the bail
  • a bond that is a guaranteed payment of the full bail amount, or
  • a waiver of payment on the condition that the defendant appear in court at the required time, commonly called "release on one's own recognizance" or simply "O.R."

According to E! Online, the deputy D.A. assigned to case says she will push for 180 days of jail time if Lohan has violated the terms of her probation.

Lohan has attended only 10 of 13 alcohol education classes required, as reported by TMZ.

Drinking alcohol, using illegal drugs and failing to either attend or abide by the terms of her alcohol-education course are all violations of Lohan's probation.

Her attorney Shawn Chapman Holley has said a temporary passport has since been issued. 

As previously discussed, Lohan pleaded guilty to misdemeanor counts of being under the influence of cocaine; no contest to two counts of driving with a blood-alcohol level above 0.08 percent and one count of reckless driving.

The actress was granted several extensions for her probation and had been warned by a prosecutor that she would face jail time if she violated her probation.
