Apple vs. Android Battle Leads to Stabbings

If you thought the Star Wars vs. Star Trek debate was serious, it's nothing compared to the Android vs. Apple battle of 2015.

Two Tulsa men, Jiaro Mendez and Elias Acevedo (note: different news sources have spelled the men's names differently, we will follow the apparent majority spelling), were arrested after a debate over who had the best smartphone, Android or Apple, turned violent.

Unsurprisingly, both men were drunk when the argument broke out. According to authorities, Acevedo bashed Mendez over the head with a beer bottle. Both men allegedly proceeded to stab each other with beer bottle shards. Adding insult to injury, Acevedo fled and attempted to steal Mendez's car. He didn't get far, as police found the car in the apartment lot.

Both men were taken to the hospital for non-life threatening injuries. Since authorities could not figure out who was the aggressor, both were charged with assault and battery with a deadly weapon.

Reports also claim that the police filed an immigration hold on Acevedo.

Immigration Hold

An immigration hold is used to detain possible immigration law violators. It is often placed after police arrest a person for an unrelated crime, and suspecting that the person may be in the United States illegally, notifies the Department of Homeland Security. The hold requires state police to transfer the defendant to federal custody at the end of a jail term.

You may face an immigration hold if:

  • You are suspected of being undocumented or illegally present in the United States.
  • You are eligible for deportation from the United States because of a conviction.
  • You have a pending order of removal.

While immigration holds can be placed on you regardless of what your arrest was for, crimes that will often trigger an immigration hold include:

  • Aggravated felonies
  • Drug offenses
  • Firearm offenses
  • Terrorist activities
  • Driving Under the Influence of Alcohol
  • Assault and Battery over an iPhone (just kidding on that last part)

Once transferred into federal custody, you may be able to post a bond and be released pending your immigration hearing. However, if you have a pending order of removal, you may be deported without any hearing. So keep your temper, and keep your smart opinions on the best smartphone to your smart little self.
