American Apparel Nail Polish Exploding on Shelves
American Apparel is famous for a lot of things.
Provocative and controversial advertising with "cocaine-chic" women. An eccentric CEO by the name of Dov Charney. Sexual harassment lawsuits.
Now American Apparel can add a new exploit to its list: exploding nail polish.
However, according to American Apparel, the exploding nail polish is not their fault, but the fault of Long Island-based Forsythe Cosmetic Group, maker of the nail polish. According to American Apparel, Forsythe put their polish in defective bottles which exploded on store shelves before American Apparel pulled them. American Apparel is suing for fraud, product liability and breach of contract, stylelist.com reports.
The exploding nail polish lawsuit seeks $5 million in damages. "We wish no ill will toward this fellow American manufacturer, but need to seek a fair and accountable solution to this incident," American Apparel spokesman Ryan Holiday told the New York Post. However, according to the lawsuit, Forsythe scammed "tens of thousands of dollars" from American Apparel after they learned the company was changing suppliers.
Forsythe denied the allegations, calling them "a suspense-novel-worthy chain of melodramatic alleged events," bellasugar.com reports. As far as denials go, Forsythe definitely wins points for style.
When it comes to injuries caused by dangerous and defective products, the date of injury is extremely important. Each state has statutes that prevent recovery after a certain amount of time has passed between the date you were injured and the date you file your lawsuit. That's why it is always advisable not to put off meeting with an attorney soon after an accident.
