Amanda Bynes' Sexual Harassment Allegations False: NYPD

NYPD authorities on Tuesday denied Amanda Bynes’ claims that officers sexually harassed her during her arrest for allegedly smoking pot in her apartment building and then throwing a bong out the window.

NYPD Deputy Commissioner Paul J. Browne confirmed that the department had internally investigated the matter and had found no evidence to back up Bynes’ allegations, reports TMZ.

Bynes’ Twitter rants may be mostly hot air, but if her allegations are true, she has cause for legal recourse.

Sexual Harassment by Police

Bynes' claimed via Twitter that one of the arresting officers "slapped [her] vagina," an allegation that NYPD sources say is contrary to the facts, The Huffington Post reports.

If the "All That" alumna was telling the truth, she could successfully sue the police for violating her civil rights.

Like in many cases of police brutality, sexual abuse by police violates both a victim's right against unreasonable seizures by law enforcement as well as their 14th Amendment right to equal protection due to gender.

Illegal Entry?

Bynes also claimed that the police "illegally entered [her] apartment" during her arrest, which without a warrant or probable cause could be a violation of her 4th Amendment rights.

However, the NYPD may have had probable cause if the "She's the Man" star's apartment door had reeked of marijuana and since her doorman had told officers that she had been smoking weed and talking to herself.

It may be a bit premature for Bynes to sue the police for illegal entry, as a judge will likely rule on whether police violated her 4th Amendment rights during a suppression hearing in her criminal case.

Twitter Feed Is Future Evidence

It might serve Bynes to stay off of Twitter while she sorts out her criminal charges, as statements like "I've never had a bong in my life!" may be used by prosecutors to prove she isn't a credible witness, even in any future sexual harassment suit.

With a new blonde plastic wig or perhaps "another nose job," Bynes is scheduled to appear in court again on July 9, reports TV Guide.
